The scariest part of all is how much easier it is to be charged with intent to distribute than you may realize.”
The lawyer explains that even if someone is just planning to share the substance with friends down the line, they can still face charges of intent to distribute under 2C:35-5 of the New Jersey Criminal Code. It does not matter whether the person planned to sell the drug or not. Simply handing off the drugs to another party can be considered distribution.
Attorney Adam M. Lustberg adds that if the cocaine is recovered in one bag, a person may face charges of possession, and law enforcement will assume that the drug is for personal use. However, if the cocaine is found in several bags, the police may assume that the drug is for distribution among several people. The charges can then change from possession to possession with intent to distribute.
