When Is a Texas Bar Liable for a Drunk Driving Crash? León Law Firm Explains

A drunk driver is not always the only party responsible for a crash. A León Law Firm guide explains when Texas dram shop law makes a bar or restaurant that served the driver liable.

Sugar Land, United States, October 23, 2026 /NewsNetwork/ -- When a drunk driver causes a crash, the driver is not always the only one who can be held responsible. A guide from The León Law Firm, P.C. explains when a Texas bar, restaurant or other business that served the driver can share liability under the state’s dram shop law. The guide is available at https://theleonlawfirm.com/drunk-driving/

Alcohol remains one of the deadliest factors on Texas roads. According to the Texas Department of Transportation’s 2025 Texas Motor Vehicle Traffic Crash Facts report, 906 people were killed in crashes involving a driver under the influence of alcohol in 2025, or 24.04 percent of all traffic deaths that year.

The rule comes from Section 2.02 of the Texas Alcoholic Beverage Code. A provider can be liable when it served someone who was obviously intoxicated, to the point of being a clear danger to themselves and others, and that intoxication caused the victim’s injuries. Providers include bars, nightclubs, restaurants, hotels with bar service and stores that sell alcohol.

The key words are “obviously intoxicated.” The test looks at what staff could see at the moment of service, not how many drinks the driver had overall. Stumbling, slurred speech or a friend offering to call a cab can all be signs. A high blood alcohol reading alone is not enough. In Raoger Corp. v. Myers, decided in 2025, the Texas Supreme Court sided with a restaurant even though the driver’s blood alcohol was 0.139 about three hours after the crash, because witnesses said he looked normal while being served.

Businesses also have a defense. Under Section 106.14, an employer can avoid liability if it required staff to complete a TABC-approved seller training program, the server actually attended it and the employer did not encourage over-service. A training certificate alone does not settle the question.

Private party hosts are generally not liable for what adult guests do after drinking. The main exception covers adults 21 or older who knowingly provide alcohol to someone under 18.

A dram shop claim can matter most when the driver carries little insurance. Texas requires only $30,000 per person in injury coverage, an amount a serious crash can easily exceed. A business that served the driver may carry liquor liability insurance, adding another possible source of recovery. In the guide, founding attorney Carlos A. León stresses moving quickly. Receipts, point-of-sale records and surveillance video can show who served the driver and when, but video is often overwritten unless someone asks for it to be preserved.

Dram shop claims generally must be filed within two years of the injury, or two years from the date of death in fatal crashes. More information about the firm’s drunk driving accident practice is available at https://theleonlawfirm.com/drunk-driving-accident-lawyer/
